1. Acceptance of Terms
By accessing and using the ADER platform (website, mobile applications, and services), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you must not use ADER.
Your use of ADER constitutes your acceptance of these terms in their entirety. Whistler CHERUBIIN reserves the right to modify these terms at any time. Continued use after modifications indicates your acceptance.
2. User Categories
ADER serves different user categories with specific responsibilities:
- Patients: Individuals living with Type 2 diabetes or pre-diabetes seeking health management support
- Healthcare Professionals: Doctors, diabetes educators, nurses, and other qualified medical practitioners
- Hospital Partners: Medical institutions and hospital systems seeking diabetes management solutions
3. Beta Program Terms
Important: ADER is currently in beta phase. Users participating in the beta program acknowledge and accept that:
- The platform is not fully tested or deployed
- Features may change, be removed, or become unavailable without notice
- Data loss is possible, and backups are not guaranteed
- Performance and reliability may vary
- Security features are under development
- The beta phase may end at any time
Users provide feedback and consent to participate in feature testing and research.
4. Account Registration & Use
To use ADER, you must:
- Be at least 18 years old (minors require parental/guardian consent)
- Provide accurate, complete, and current information
- Maintain the confidentiality of your login credentials
- Accept responsibility for all activity under your account
- Notify us immediately of unauthorized access
Whistler CHERUBIIN reserves the right to suspend or terminate accounts that violate these terms or provide false information.
5. Permitted Uses
You agree to use ADER only for legitimate purposes:
- Personal diabetes management and health tracking
- Receiving health insights and recommendations (for informational purposes only)
- Communicating with healthcare providers (where applicable)
- Participating in research with explicit consent
- Accessing information about diabetes management
6. Prohibited Uses
You agree NOT to use ADER for:
- Illegal, harmful, or deceptive purposes
- Transmitting viruses, malware, or harmful code
- Attempting unauthorized access to platform systems
- Hacking, reverse-engineering, or attempting to disrupt services
- Violating intellectual property rights
- Harassment, threats, or defamation of other users
- Collecting or harvesting user data without consent
- Impersonating medical professionals without qualification
- Selling, trading, or sharing access credentials
- Using ADER for commercial purposes without authorization
7. Medical Disclaimer
CRITICAL: ADER is NOT a medical device or a substitute for professional medical advice, diagnosis, or treatment.
By using ADER, you understand and agree that:
- ADER provides information and recommendations for educational purposes only
- You should NOT rely solely on ADER for medical decisions
- You MUST consult qualified healthcare providers before changing medical treatment
- Emergency situations require immediate contact with emergency services, not ADER
- You assume all responsibility for decisions made based on ADER information
- Whistler CHERUBIIN is not liable for health outcomes resulting from ADER use
8. Data & Privacy
Your use of ADER is governed by our Privacy Policy. By using ADER, you consent to data collection and processing as described in the Privacy Policy.
Key points:
- Health data is collected to provide services and improve the platform
- Data may be shared with hospital partners in aggregated, anonymized form (with consent)
- You have the right to access, modify, and delete your data
- Data is protected by encryption and security measures
9. Intellectual Property
All content on ADER, including text, graphics, logos, code, and features, is the intellectual property of Whistler CHERUBIIN or licensed partners. You may not:
- Copy, modify, or distribute ADER content without permission
- Create derivative works based on ADER technology
- Reverse-engineer or decompile ADER code
- Use ADER's name, logo, or branding without authorization
10. User-Generated Content
If you submit content (health data, feedback, messages) to ADER:
- You grant Whistler CHERUBIIN the right to use, store, and process this content
- You confirm you own or have rights to the content
- You consent to anonymized use in research and platform improvement
- Whistler CHERUBIIN may aggregate your data with other users for research
11. Third-Party Services
ADER may integrate with third-party services (DiGA, PECAN, hospital systems). Your use of these integrations is subject to:
- Third-party terms of service
- Their privacy policies
- Their data security practices
Whistler CHERUBIIN is not responsible for third-party services, data breaches, or policy changes.
12. Service Availability & Support
Availability: ADER is provided "as is" without guarantees of uninterrupted service. Scheduled maintenance, outages, or platform changes may occur without notice.
Support: Support is provided at Whistler CHERUBIIN's discretion. Response times are not guaranteed.
Service Interruption: Whistler CHERUBIIN may discontinue ADER or specific features at any time, particularly at the end of the beta phase.
13. Liability Limitations
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Whistler CHERUBIIN is not liable for indirect, incidental, special, or consequential damages
- Not liable for data loss, business interruption, or lost profits
- Not liable for errors, omissions, or inaccuracies in health recommendations
- Not liable for unauthorized access to user accounts (if user negligence contributed)
- Your total liability is limited to amounts paid for ADER services (if any)
14. Indemnification
You agree to indemnify and hold harmless Whistler CHERUBIIN from any claims, damages, or losses resulting from:
- Your violation of these terms
- Your use of ADER in unauthorized ways
- Your infringement of third-party rights
- Your medical decisions based on ADER information
- Content you submit to ADER
15. Termination of Access
Whistler CHERUBIIN may terminate your access to ADER immediately for:
- Violation of these terms or the Privacy Policy
- Illegal or harmful conduct
- Security threats or suspicious activity
- Providing false information
- End of beta phase or platform discontinuation
Upon termination, your account data will be handled according to the Privacy Policy.
16. Compliance with Laws
You agree to comply with all applicable laws and regulations, including:
- French and EU data protection laws (GDPR)
- French healthcare privacy laws
- Laws regarding unauthorized access to computer systems
- Laws regarding healthcare practice and medical advice (for professionals)
17. Dispute Resolution
Governing Law: These terms are governed by French law.
Jurisdiction: Any disputes shall be resolved in French courts.
Mediation: Before litigation, parties may seek mediation to resolve disputes amicably.
